Professional Career
After law school, Upadhyaya clerked for former D.C. Court of Appeals chief judge Eric Washington for two years before joining Venable LLP to practise complicated commercial and administrative litigation. In 2006, Venable recognised Upadhyaya Pro Bono Lawyer of the Year for her work representing destitute individuals in post-conviction hearings.
In 2009, the Mid-Atlantic Innocence Project named her Defender of Innocence. Upadhyaya joined the D.C. District Court in 2011 as the first legal clerk to incumbent district judge Robert Wilkins from 2011 to 2012. She returned to Venable and became a partner, doing litigation until her bench appointment. To examine attorney allegations, Upadhyaya served on the D.C. District Court’s Committee on Grievances from 2021 to 2022.
Judge Upadhyaya was the first judge Trump faced in court when a grand jury indicted him on August 1, 2023, for interfering in the 2020 presidential election. She scheduled pre-trial motions and discovery during this session.
